By downloading, using the Avocado software, or accessing avocadonotch.com, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using the software.
A purchased license grants you a personal, non-transferable, non-exclusive right to use the Avocado macOS application. A standard license allows activation on up to 2 personal devices owned by the license holder. Sharing licenses publicly or across a large organization under a single personal seat is strictly prohibited.
Avocado is a digital software product distributed exclusively via download. All fees are payable in advance on a one-time basis. All sales are final and strictly non-refundable. Avocado will have no liability to the Client for refunding any fees charged or paid. We provide a full-featured "Free Trial" version, and strongly encourage all users to thoroughly test the software to ensure it meets their needs prior to purchasing a permanent license.
You may use Avocado to assist with any personal or commercial videography, presentations, or live broadcasts. We do not lay claim to any content or scripts you process through the software.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVOCADO OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SOFTWARE.
UNDER NO CIRCUMSTANCES WILL AVOCADO BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SOFTWARE. AVOCADO ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, INACCURACIES, INTERRUPTION OR CESSATION OF TRANSMISSION RESULTING FROM YOUR USE OF OUR SOFTWARE.
We reserve the right to modify or replace these Terms at any time. Significant changes will be visible either via application updates or notices on the website. Continued use of the software constitutes acceptance of those changes.
